Terms of Service

1. Terms

These Terms of Service are an agreement between you and Red Arrow Marketing, LLC ("Red Arrow Marketing", "we", "us"), the company that operates Morterra. They cover the Morterra web site at https://morterra.com, the game, and its game servers (together, the "Services"). By accessing the Services, you are agreeing to be bound by these Terms, our Rules and our Privacy Policy, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing the Services. The materials contained in the Services are protected by applicable copyright and trade mark law.

2. Who May Play

You must be at least 13 years old to use the Services. If you are under 18 (or the age of majority where you live), you may only use the Services with the permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for any purchases you make. Morterra is not directed at children under 13; if we learn that an account belongs to a child under 13, we will delete it.

3. Accounts

  1. You can play as a guest without registering. Guest progress is tied to the browser you play in and can be lost if you clear its storage. You can turn a guest into a registered account at any time.
  2. A registered account needs a username, a password and a valid email address, which we use to verify the account, recover a lost password and contact you about your account or purchases. You are responsible for keeping your password secret and for everything done with your account. Tell us at once at help@morterra.com if you think someone else has used it.
  3. Usernames must not be offensive, impersonate anyone, or infringe anyone's rights. We may rename or remove accounts that break this rule.
  4. Accounts are personal. You may not sell, trade, share or transfer your account, or buy or sell in-game items for real money outside our shop.

4. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Morterra's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    3. attempt to decompile or reverse engineer any software contained on Morterra's web site;
    4. remove any copyright or other proprietary notations from the materials; or
    5. transfer the materials to another person or "mirror" the materials on any other server.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Red Arrow Marketing at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

5. Conduct

You agree to follow the Rules. In particular, you may not cheat, use bots, modified clients or exploits, attack or overload our servers, harass other players, or use the Services for anything illegal. We may mute, suspend or ban any account, remove content, or reset in-game progress if we believe the Rules or these Terms were broken.

6. Chat, Voice Chat and Player Content

Text chat and proximity voice chat are shared with other players and are not pre-screened, so you may encounter language you find offensive. You are responsible for what you say. Voice chat is relayed live through our servers to nearby players and is not recorded by us, but other players may record what they hear. Global chat messages, together with your username, may be shown in our public Discord server. Anything you build or write in the game may be seen, changed or destroyed by other players and is removed when a world is wiped.

7. Crowns, the Shop and Membership

  1. Crowns. Crowns are Morterra's virtual currency. You buy them in packs for real money, and members get some each month. You spend them in the shop. Crowns have no cash value, cannot be exchanged back for money, sold or transferred to another account, and are not your property. Unused Crowns stay on your account, but we may remove them from an account banned for breaking the Rules or these Terms.
  2. The shop. The shop sells cosmetic items and name colours for Crowns. Cosmetics only change how you look and never give an advantage in the game. Each account gets its own selection of items every week, picked at random from the cosmetics we offer, and shows the price in Crowns before you buy. You can refresh your selection for the number of Crowns shown, which replaces the items you have not bought with a new random selection. Buying an item gives you a limited, personal, non-transferable license to use it in Morterra. Items you buy stay on your account, including through world wipes.
  3. Payments. Payments are processed by Stripe, in the game or on Stripe's checkout page. We never see or store your card details. Prices are shown in US dollars, or in your local currency where Stripe offers it, before you pay, and taxes are added where required. Before you pay, you ask us to deliver your purchase right away; if you live in the EU or the UK, you agree that you lose your 14-day right of withdrawal once it has been delivered.
  4. Membership. The membership costs the price shown at checkout (currently $4.99 per month) and renews automatically every month until you cancel. While it is active, members get a member badge by their name in the game, 300 Crowns for each paid month, and two extra slots in their weekly shop. You can cancel at any time from your account page; the membership stays active until the end of the month already paid for and is not charged again. Member-only cosmetics are available only while the membership is active.
  5. Donations support the game. They are not tax deductible and do not buy anything beyond the supporter badge shown with them.
  6. We may change, add or retire shop items and prices at any time. A price change for the membership applies from your next renewal, and we will tell you about it in advance.

8. Refunds

Crowns, items and membership time are delivered to your account right after payment, so purchases, Crowns spent in the shop and donations are final and non-refundable, except where the law requires otherwise. If something went wrong, for example you were charged twice or an item never arrived, email help@morterra.com within 30 days of the charge with your username and we will fix it or refund you. If you dispute a charge with your bank instead of contacting us, we may suspend the account while the dispute is open. Accounts banned for breaking the Rules or these Terms are not refunded. If we shut down the Services permanently, we will give at least 30 days' notice and refund any membership time already paid for but not yet used.

9. Game Worlds and Wipes

Game worlds are wiped regularly (currently about once a month). A wipe resets the world and every character in it, including items, buildings and stats; it does not affect your account, shop purchases or membership. Season highscores may be archived and shown in the game with your username. We may also reset, move or close worlds, or change any part of the game, at any time. Nothing you have in a game world is guaranteed to last.

10. Disclaimer

  1. The materials on Morterra's web site are provided "as is". Red Arrow Marketing makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Red Arrow Marketing does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site. We do not promise that the Services will always be available or free of errors.

11. Limitations

In no event shall Red Arrow Marketing or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Morterra's Internet site, even if Red Arrow Marketing or a Red Arrow Marketing authorized representative has been notified orally or in writing of the possibility of such damage. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the 12 months before the claim. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

12. Links and Third-Party Services

Red Arrow Marketing has not reviewed all of the sites linked to the Morterra web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Red Arrow Marketing of the site. Use of any such linked web site is at the user's own risk. Third-party services we use, such as Stripe (payments) and Discord (community), have their own terms and privacy policies, which apply when you use them.

13. Termination

You can stop using the Services at any time and ask us to delete your account (see the Privacy Policy). We may suspend or end your access if you break these Terms or the Rules, or if we stop offering the Services. Sections 7 to 11 and 15 continue to apply after your access ends.

14. Revisions and Errata

The materials appearing on Morterra's web site could include technical, typographical, or photographic errors. Red Arrow Marketing does not warrant that any of the materials on the Morterra web site are accurate, complete, or current. Red Arrow Marketing may make changes to the materials contained on the Morterra web site at any time without notice. Red Arrow Marketing does not, however, make any commitment to update the materials.

15. Governing Law

Any claim relating to Morterra's web site or the Services shall be governed by the laws of the State of Texas without regard to its conflict of law provisions. This does not take away any rights you have under the consumer protection laws of the country where you live.

16. Changes to These Terms

Red Arrow Marketing may revise these terms of use for the Morterra web site at any time. We will change the "Last updated" date above, and for significant changes we will give notice on the site or by email. By continuing to use the Services after a change, you agree to be bound by the then current version of these Terms.
